IMPORTANT: READ CAREFULLY. THIS IS A CONTRACT.
These Terms and Conditions ("Terms") govern your access to and use of the Fitanda platform ("Service") provided by Fitanda ("We," "Us"). By accessing or using the Service, you ("Personal Trainer," "PT," or "User") agree to be bound by these Terms.
1. Description of Service
Fitanda is a precision coaching platform that provides tools for PTs and coaches to manage clients, deliver workout and meal plans, track performance and adherence (including mood/habits), and handle administrative tasks like invoicing and scheduling.
2. User Responsibilities (The PT)
As a User of the Service, you agree and warrant that:
Accuracy of Data
All information provided to Fitanda during registration, billing, and use is accurate and complete.
Lawful Use
You will use the Service only for lawful purposes and in compliance with all applicable local, state, national, and international laws, including data privacy laws.
Client Consent & Compliance (Crucial)
You are solely responsible for obtaining and documenting the necessary informed consent from your clients for the collection, storage, and processing of their personal data, especially sensitive health data (mood, pain, injury notes). You must ensure your use of Fitanda complies with regulations such as GDPR (if applicable to your clients).
3. Financial Terms
Fees
Access to the Service is granted upon timely (on time) payment of the subscription fees relevant to the tier you have selected.
Invoicing & Payments
Fitanda provides tools for the PT to generate and send invoices and collect payments from clients. Fitanda is not responsible for any disputes, chargebacks, or collection issues between the PT and their clients. We act purely as a financial intermediary/tool provider.
4. Termination
Fitanda reserves the right to suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach any of the Terms, particularly those related to unlawful use or data compliance.
5. Limitation of Liability
Fitanda provides the Service on an "as-is" and "as-available" basis. Fitanda shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, resulting from the use or inability to use the Service.
